AGREMENT


For supplying fuel oil in vessel of BIWTC through automatic barge/ tanker in passenger service at Dhaka Terminal this supplementary Agreement is executed between two parties today 29.10.2013 Tuesday under the following conditions:
First Party (appointment authority)

 

Burigonga Floating Pump Ltd. 131 Motijheel C/A, Dhaka-1000

Second party (Fuel oil supplier)

Condition & Rate

1. As fuel oil supplier in vessel from 01.11.2013 to 31.10.2015 for 02 (two) years re0appointed to Burigonga Floating Pump Ltd. vide letter No. 18.151.026.13.36(Ka) 2013-357 date: 28.10.2013 as fuel oil supplier.

2.       Fuel oil will supply in vessel at the rate of Govt. price of supplied fuel oil (HSD) (per liter) and transport cost at the rate of 0.00 (Zero point zero zero) Taka per liter.

3.       Appointing period of Second party from 01.11.2013 to 31.10.2015 i.e. for 02 (two) years. But for violating any cause mentioned in Tender Document First Party is allowed to cancel appointment of 2nd party through giving 01(one) month’s notice.



4.       Moreover others all conditions of agreement executed on 31.10.2011 with Second party will be unchanged.

5.       For arising any contradiction about above conditions the decision of BIWTC council will be considered a final.

Under the transfer schedule property mainly Mr. A.K.M. Aminul Islam, son of Enayet Ullah being the owner and possession holder in the S.A. record in his  own name included after enjoying on the dated last  20-09-1966 AD in the Dhaka Central Sub-Registry Office vide 4287 No. Sale Deed by it Sufia Khatun, wife of A.K.M. Aminul Islam to him was sold was become owner and possession less.

Later Sufia Khatun described property being the owner and possession holder and own name  on the passed dated 25/12/1969 AD Mutation and Partition Case No. 970/69, dated : 25/12/1969 vide it 148/4 No. Jote 357 No. Ledger in own name making mutation and partition and would enjoy and in the R.S. record in own name after correctly and record included and through paying of the rent/tax and during the period of owner and possession holder of his 2(tw) son Yeaminul Islam and Saiful Islam, 2(two) daughter Nasrin  Islam and Afrin Chowdhury keeping heris was died.

Later Sufia Khatun of his heirs and successors in own name after making mutation and patition and during the enjoying period on the passed dated 25/12/1969 AD vide Mutation and Partition Case No. 970/69, dated : 25/12/1969 vide No. 148/4 No. Jote in the leader No. 357 No. in own name making mutation and partition was enjoying  and in the R.S. record own name after correctly recorded and making record inclusion and through paying of the rent tax and during the period of owner and possession holder 2(two) sons Yeaminul Islam and Saiful Islam, 2(two) daughter Nasrin Islam and Afrin Chowdhury keeping them heir was died.
Later Sufia Khatun keeping heirs in their own name after making mutation and partition and during the enjoying period, there had declare to sale of the said land Metro Homes Limited and wished to purchase of the said land and in the Mohammadpur Sub-Registry Office : 02-07-2006 AD/03-07-2006 AD vide 6406 No. Sale Deed was sold and became owner and possession less forgood.

Later Metro Homes Limited in own name was became mutation and partition of which Mutation and Partition Case No. 6221/06, dated : 08/10/06 and Jote No. 154/30 and in the City Survey Mutation and Partition Ledger No. 5081 No. Ledger  Plot No. 312, of which 188/2 No. Jote situated and in the said property 10-storied “Metro Melodi” named  apartment building construction decision was taken and after making of the design map and in the Rajuk Office  after given submission and taken the permission of it and according to the design map construction of it performed.
